Reference to “you” is a reference to the purchaser of the Goods from us.

“Goods” means the jewellery and other items purchased by you from us.

We use third party services from Google Analytics and Wix.

We have two databases of information, our shop Clarity computer which holds order information and our Website WIX, which holds our mailing list.  Your data will only be on the shop computer, if you have ordered via the shop.  It will be on the WIX database if you have ordered via wix, or engaged in social media and opted into being on our mailing list. 

If you wish to unsubscribe from our mailing list, please send an email with the word 'unsubscribe' as the title to catherine@catherine-bishop.com.  If you wish to see your data, or be deleted please email catherine@catherine-bishop.com 

 

4. RIGHT TO CANCEL

 

 

You have the right to cancel the purchase of a good without having to give a reason at any time within the "cooling off period" of seven working days, beginning on the day after you receive the goods.

 

If not entirely satisfied we are here to help sort anything out for you. Please email us at catherine@catherine-bishop.com quoting your name, address and order reference.

 

 

If notified of an issue up to 7 days from receipt of your item, we will always offer an exchange or replacement to ensure your complete satisfaction.

 

 

However, if you notify us within 7 days of receiving an item that you would prefer to cancel, then providing you return the item within 14 days of this cancellation notification, you will receive a full refund no later than 30 days after the cancellation notice. All refunds will be made the same way the item was purchased and only to the purchaser.

 

 

Whether for exchange, replacement or refund, any item returned must be in ‘as new’ condition and sent to us using a signed for (at our end to confirm receipt), fully insured and proof of postage service.  The item should be in its original packaging to provide adequate protection.  Alternatively, you can personally return the item to a staff member in our shop.

 

You must send the goods back to us to our contact address at your own cost (unless we delivered the item to you in error or the item is damaged or defective) as soon as possible once you have cancelled the contract.  We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense. 

 

When in possession of the goods you are under the duty to take reasonable care of them.

 

You will not have any right to cancel a purchase for the supply of any of the following goods:

  • For the supply of goods made to your specifications or clearly personalised or for the supply of goods we do not own and are sold on behalf of the owners.  These are displayed as Commission Sales.

 

5. NOTICES 

 

If you wish to give us any notice relating to a matter covered by these Terms you must confirm that notice in writing. In the case of email notices, these should be sent to catherine@catherine-bishop.com and you must send them so as to return an acknowledgement of receipt.

 

Notice may be sent by post (please retain proof of postage) to Catherine Bishop at CB Jewellery Ltd, 14 High Street, Barnstaple, North Devon, EX31 1BG. 

 

We may give notice to you at either the email or postal address you provide to us when making a purchase. (Notice will be deemed received and properly served 24 hours after an email is sent or three days after the date of posting of any letter.)

 

6.  EXCLUSION OF LIABILITY

 

We use reasonable endeavours to ensure that the data on the Website is accurate and to correct any errors or omissions as soon as practicable after being notified of them. To the extent permitted by applicable law, we disclaim all representations (whether expressed or implied) as to the accuracy of any information contained on the Website. We do not guarantee that the Website will be fault free and nor will we accept liability for any errors or omissions.

 

Due to the nature of electronic transmission of data over the internet, and the number of users by whom data is posted on to the Website, any liability we may have for any losses or claims arising from an inability to access the Website, or from any use of the Website or reliance on the data transmitted using the Website, is excluded to the fullest extent permissible by law. In no event shall we be liable for any loss of profit, revenues, goodwill, opportunity, business, anticipated savings or other indirect or consequential loss of any kind in contract, tort (including negligence) or otherwise arising out of use of the Website, save where such liability cannot be excluded by law.

 

We do not warrant that the Website is free of viruses or anything else which may have a harmful effect on any technology.

 

FORCE MAJEURE

 

We will not have any liability to you if we are prevented from performing any of our obligations due to circumstances beyond our reasonable control which includes, but is not limited to, extreme weather conditions, act of God, terrorism, war, strike, or difficulty in obtaining materials and/or labour and third party services including postage.  In any of these circumstances, we reserve the right to terminate the Contract.

 

7. GENERAL

 

If any provision of these terms and conditions is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these terms and conditions shall not be affected.  

 

We may modify these terms and conditions at any time by publishing the modified terms and conditions on this Website. Any modifications shall take effect 3 days after posting on this Website.

9. CONCLUSION  

 

These terms are governed by English law. Any contract for the purchase of goods from this site and any dispute or claim arising out of or in connection with any such contract will be governed by English law.
